The filing of the demand constitutes the election of all PCT contracting states designated in the international application and bound by PCT Chapter II for a national and where possible a regional patent at the same time (see point 113). If after filing the PCT request the applicant has validly withdrawn a designation, the filing of the demand cannot constitute the election of that state.
