If the applicant has filed a request for examination before the search report has been transmitted to him, the EPO will invite him to confirm, within the six-month period, that he desires to proceed further with his application. If the applicant fails to reply in due time to this invitation, the application will be deemed to be withdrawn. In this case, however, the means of redress provided for in Art. 121 (further processing of the application) and in Art. 122 (restitutio in integrum) will apply. The examination fee is refunded in full if the application is withdrawn or refused or is deemed to be withdrawn before the responsibility for the procedure passes to the Examining Division.
